Terms of Service

1. Service Description

CriteriaI ("the Service") is a web-based platform operated by LayerThe ("we", "us", "our") that evaluates EU grant proposals against historical data from Horizon Europe and Horizon 2020 programmes. The Service provides AI-generated evaluation reports including novelty scores, call fit analysis, consortium recommendations, and similar funded project identification.

2. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction.

3. Credits & Billing

The Service uses a credit-based system. Free accounts receive 3 evaluation credits. Paid plans provide additional credits per billing period as described on our Pricing page.

All payments are processed by Paddle.com Market Ltd, acting as our Merchant of Record. Paddle handles billing, VAT calculation, and payment compliance. By purchasing a plan, you also agree to Paddle's Terms of Service.

Credits are allocated per billing period and reset on renewal. Credits are non-transferable and non-refundable except where required by applicable law or in the event of a service failure where credits are automatically refunded.

4. Intellectual Property

Your content: You retain all rights to your proposals, objectives, and any text you submit. By submitting content, you grant us a limited licence to process it for the purpose of generating evaluations.

Our methodology: The evaluation methodology, scoring algorithms, prompt engineering, and the structure of generated reports are our intellectual property.

CORDIS data: The underlying project data is sourced from the European Commission's CORDIS database and is subject to the EU's open data licence.

5. Disclaimer — Advisory Nature of Evaluations

Evaluation scores and recommendations are generated by AI and are advisory in nature. They do not guarantee funding outcomes and should not be used as the sole basis for submission decisions.

While we strive for accuracy by benchmarking against 55,000+ funded projects, AI-generated analysis may contain errors, omissions, or biases. Always review results critically and consult domain experts before making funding decisions.

6. Data Processing

We process your data in accordance with our Privacy Policy. By using the Service, you acknowledge that your proposal text is sent to third-party AI providers (OpenAI) for embedding generation and evaluation. These providers operate as sub-processors under data processing agreements.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service
  • Share account credentials or allow unauthorised access to your account
  • Submit content that infringes third-party intellectual property rights
  • Abuse the evaluation system (e.g., submitting nonsensical input to deplete credits or test system limits)
  • Use automated tools (bots, scrapers) to access the Service without prior written consent

8. Report Sharing

You may share evaluation reports with third parties via shareable links, subject to the limits of your plan. You are responsible for ensuring that you have the right to share the content of your proposals with the intended recipients. We are not responsible for how recipients use shared report data.

9. Communications & Notifications

The Service sends transactional notifications via two channels: in-app dashboard notifications and email. Notifications fall into four categories:

  • Evaluations — completion, failures, and credit refunds
  • Report Sharing — shares received, reports viewed
  • Billing & Credits — subscription changes, credit balance alerts
  • Data & Insights — new data availability and feature updates

You can manage your notification preferences from Settings → Notifications. In-app and email channels can be toggled independently per notification type.

These are transactional communications related to service delivery, not marketing emails. For details on how notification data is processed, see our Privacy Policy.

10. Termination & Account Deletion

You may cancel your subscription at any time from the Settings page. Access continues until the end of your current billing period.

You may delete your account at any time from Settings > Account. Account deletion permanently removes all your data (proposals, evaluations, profile, credits, shared reports) and cannot be undone.

We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable.

11. Limitation of Liability

To the maximum extent permitted by law, LayerThe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any errors or inaccuracies in evaluation scores or recommendations
  • Unauthorised access to or alteration of your data
  • Actions of third-party sub-processors

Our total liability for any claims under these Terms is limited to the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Türkiye. This does not affect your statutory rights as a consumer under the laws of your country of residence within the EU.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
